Ombudsman investigation

The Ombudsman undertook an investigation into the release of personal information in error by public authorities implementing decision on assessed disclosure applications under the Right to Information Act 2009. He found that errors were frequently occurring and that this systemic issue must be addressed by public authorities to ensure that all reasonable steps have been taken to prevent the unjustifiable disclosure of personal information during the right to information process. The Ombudsman made five recommendations to all public authorities fully subject to the Right to Information Act in his investigation report released in March 2026.

Guidelines

The Ombudsman is required by s 49(1) of the RTI Act to issue and maintain Guidelines relating to certain aspects of the Act. He is also given power by s 49(1) to issue Guidelines on any matters which he considers necessary.

The Ombudsman has issued the following Guidelines under s 49(1) of the RTI Act -
