On 6 August 2019, the University of Tasmania (the University) accepted an assessed disclosure application under the Right to Information Act 2009 (the Act) from “N”.
The University released some information with exemptions applied under s36 to the names of employees and exempted the balance of the information by applying ss31 (legal professional privilege), 35 (internal deliberative information), 36 (personal information) and 39 (information obtained in confidence).
The Ombudsman considered the approach taken by the University and the adequacy of the reasons provided.
The Ombudsman determined that:
- Exemptions claimed by the University under ss31 and 39 were set aside;
- Exemptions claimed by the University under s35 were varied; and
- Some information was exempt under s36.
The Ombudsman has decided to publish this short summary of his decision only, as he considers it appropriate in the circumstances.
