Personal Information Protection
Personal information means any information or opinion in any recorded format about an individual whose identity is apparent or is reasonably ascertainable from the information or opinion.
The Ombudsman has the responsibility for overseeing the operation of the Personal Information Protection Act 2004.
The object of the Act is to regulate the collection, maintenance, use and disclosure of personal information relating to individuals.
The Act applies to the Tasmanian public sector, local government, the University of Tasmania and other statutory office holders and bodies falling within the meaning of a “personal information custodian” as defined by the Act.
The Act contains procedures for the making of complaints to the Ombudsman in relation to the alleged contravention by a “personal information custodian” of a personal information protection principle that applies to the person.
Before making a complaint to the Ombudsman an individual must have raised the matter with the relevant personal information custodian and is not satisfied with the response that was received. A complaint can then be lodged with the Ombudsman.
